3. Responsibilities

User responsibilities

Users are responsible for safeguarding their account credentials, including usernames and passwords. Credentials must not be shared and users should ensure their devices are secure. If unauthorized access is suspected, users must notify us immediately by sending an e-mail to [email protected] or any other means which do not expose private or confidential information. The platform must not be misused for illegal, unethical, or unauthorized purposes. This includes, but is not limited to, violating intellectual property rights, uploading prohibited content, or engaging in activities that harm other users or compromise the functionality of COLABORATORI - users engaging in such activities will be banned and therefore prohibited from using the website or the services. While COLABORATORI facilitates the uploading and management of content and provides limited, temporary storage, it is the responsibility of users to maintain their own backups of uploaded files and data. COLABORATORI does not guarantee permanent storage or the recovery of lost or deleted content. Users must also notify us whenever they identify a software bug or issue which impacts the service and results in a certain feature being unusable, impractical or partially functional.

Users are solely responsible for any data or content they upload, add, publish, or otherwise make available through COLABORATORI. They must ensure that it is accurate, complete, current, and lawful. Users must not misrepresent reality, actions, qualifications, or identity; impersonate another person or entity; create a false identity; or otherwise induce or lead other people into error through the applicable platform actions.

Examples of activities which will result in permanent or temporary suspension of the services:

  • attempting to access another user's account
  • automated/manual scanning or data scraping
  • vulnerability exploitation or abusing software bugs
  • any action affecting the confidentiality, integrity or availability of the website or services

Please note this is not an exhaustive list.

COLABORATORI responsibilities

We are responsible for providing the service to the user and ensure continuous improvement to the platform. We are responsible for remediating errors which arise from using the service. We will apply due diligence whenever we engage in choosing a new service provider or replace an existing one. We will constantly assess the security posture of the service and apply appropriate measures to ensure confidentiality, integrity and availability of the service. We are also responsible for providing feedback and support to our users. Although we take into account the most voted users requests and adjust development accordingly, we cannot guarantee that each request (including most voted requests) will be implemented as they might be conflicting with the strategic direction and business development of the service. Example: we will prioritize the development of simple features impacting more users rather than complex features impacting few users.

4. Limited Availability

COLABORATORI is provided "as is" and "as available." We do not guarantee uninterrupted service, error-free functionality, or the absence of downtime. The platform's services may be modified, suspended, or discontinued at any time without prior notice or liability. Certain features might not yet be available and will be released as we are progressing with the development. We reserve the right to discontinue any feature or service based on the business and strategic evolution of the services or other factors which are not under our control regardless whether the services are in Beta State (a state which implies continuous modification of the service) or in any other states. COLABORATORI integrates with additional service providers to enable its functionality. We are not responsible for the availability, performance, decisions or outcomes of these external services.

5. Limited Usability

COLABORATORI does not guarantee the accuracy, reliability, or legality of either the user uploaded content or data sources used by the service. Users agree to use the platform at their own risk and accept full responsibility for the data and actions while engaging with COLABORATORI or its service providers. Whenever Users engage with the services (free or paid) they agree with the specific features highlighted in the Offer Table presented on the Landing Page or inside the application under the Subscription & Referral section and also agree with the features highlighted in the Feature Cards section on the Landing Page.

Device and screen limitations

When you access the service from a smartphone or another device with a screen smaller than 13 inches diagonally, functionality may be limited. Some controls, layouts, workflows, or features may be unavailable or may not operate as intended on smaller screens. For the fullest functionality, use a supported browser on a screen of 13 inches or larger where practical.

6. Data Privacy & Protection

COLABORATORI employs industry-standard encryption protocols such as SSL/TLS and secure storage methods like AES to protect user accounts, uploaded content, and credentials. While we take reasonable precautions to safeguard our systems, we cannot guarantee absolute security. Users acknowledge they are using the platform at their own risk. COLABORATORI collects and processes data in compliance with GDPR. We do not sell, rent, or share user data with service providers or third parties for marketing purposes and do not engage in customer profiling. Data collected during use is explicitly provided by users, such as during account registration or data uploads, and is used solely to deliver and optimize the services. By using our services you agree to the complete Data Privacy Annex as presented in here. We continuously improve the security of the services and adapt based on newly discovered threat vectors, vulnerabilities, misconfigured software and the market in general. Whenever we deploy Security Measures we may temporarily impact the availability of the services in order to prevent, identify or eliminate attacks or attackers. We reserve the right to apply security measures without noticing the Users.

6.1 Public Information and Ongoing Consent

By creating an account, submitting content, enabling a profile, listing, project, Alter Ego, portfolio, contact surface, or another service-facing feature, or using any free or paid service, you acknowledge and expressly consent that the information you provide for that purpose may be shown to other users or made publicly accessible. Information you regard as private may therefore become public when you submit it for a public or service-facing feature. Do not submit information that you do not want disclosed.

Where a feature includes a visibility control, that control is a product setting and is not a promise of confidentiality. We may change visibility defaults or functionality, including making service-related information that was previously private public, subject to applicable law. This consent does not by itself make account credentials, payment credentials, security data, or private support communications public unless you expressly submit them for publication.

Your continued access to or use of COLABORATORI after these Terms, a privacy notice, a visibility change, or a service change has been published constitutes your continuing consent to the processing, display, and publication described in this section. If you do not consent, stop using the relevant feature and the services, remove the affected content where the platform allows it, or contact us about an available deletion request. We may retain information where required by law or reasonably necessary to protect the platform and enforce these Terms.

7. Subscriptions & Payments

By opting for paid services, users agree to the pricing, billing, and cancellation terms outlined at the time of purchase. Users have the right to withdraw from their purchase within 14 days of the transaction date. Revolut Business handles payment credentials and payment authorization on our behalf. We retain limited records needed to create, reconcile, support, and document transactions, including transaction identifiers, payment status, invoice and customer information, provider references, checkout metadata, and related billing records. We do not intentionally store complete card numbers or CVV/CVC security codes on our servers. Revolut Business may retain a payment method for recurring payments when this is enabled or authorized by the user. Our services (including paid services) are constantly being updated or modified. By subscribing to a paid service, Users agree and authorize Revolut Business (on behalf of PAX GLOBAL S.R.L) to automatically charge their card whenever next payment date is due, based on the billing cycle presented when purchasing the service. In order to cancel their subscription, users can log in their account and click the "Downgrade" button in the Subscription & Referral section. Given that users downgraded before the next billing cycle, they will still be able to access the paid services until that specific date. Unless we expressly state otherwise, all payments are to be made through a payment card. Whenever a payment is made, the User consents that he is authorized to use that specific Payment Card. If your Payment Card is declined when we attempt to charge it for a renewal for a retryable reason, the payment provider will automatically retry the saved payment method every 12 hours during a 72-hour renewal grace period. If payment is still not received after that grace period, the subscription may downgrade to Free or require a payment method update and resubscription, depending on whether cancellation was requested and whether the saved payment method remains valid. If we do not receive payment associated to the next billing cycle, we will suspend or terminate your Subscription. We never ask for your full payment credentials, however we may ask you for associated information about a transaction in order to remediate errors which might arise when using the services.

We may introduce, withdraw, rename, combine, split, or otherwise change plans and services, including their prices, fees, discounts, billing cycles, quotas, eligibility requirements, features, and availability. Changes may also include included features and usage limits. Changes apply to new purchases when they are displayed on the applicable purchase surface. Changes to recurring subscriptions apply from future renewals after any notice required by applicable law, and users may cancel or downgrade before that renewal. Continued use after the effective date of a change constitutes acceptance of the changed service and pricing, subject to mandatory consumer protections.

8. Intellectual Property

Users retain ownership of their content. By using the platform, users grant COLABORATORI a non-exclusive license to process data solely for providing the platform's services. COLABORATORI will not interfere with users' copyright or intellectual property rights. All data, design, features, and source code associated with the COLABORATORI platform, including but not limited to logos, branding, software architecture and underlying technology, are the exclusive property of PAX GLOBAL S.R.L. These are protected under copyright, trademark, and other intellectual property laws. Users are prohibited from copying, reproducing, distributing, or reverse-engineering any part of the platform without prior written consent from COLABORATORI. Unauthorized use of PAX GLOBAL S.R.L.'s intellectual property may result in legal action.

9. Termination

COLABORATORI reserves the right to suspend or terminate user accounts for violations of these Terms of Use, misuse of the platform, or any other reason deemed necessary at its sole discretion.

10. Changes to Terms

These Terms of Use may be updated periodically. Continued use of COLABORATORI after changes to these Terms, the Privacy Policy, visibility rules or settings, or the services are published or otherwise made available constitutes your continuing consent to the updated terms, privacy practices, visibility arrangements, and services. It also constitutes acceptance of the processing, publication, service features, plan terms, and pricing described in them. We may revise included features, usage limits, plan structure, and service availability when the platform evolves. If you do not agree with a change, you must stop using the platform and any affected services.

11. Dispute Resolution and Governing Law

Disputes arising from these Terms of Use will first be addressed through good-faith negotiation or mediation between the user and COLABORATORI in accordance with Romanian and European law.
